This SMS Consent Policy describes how DeepCura Inc. (“DeepCura,” “we,” “us,” or “our”) and participating healthcare practices collect, manage, and honor patient consent for text (SMS/MMS) messages sent through the DeepCura AI receptionist platform.
1. Program Description
DeepCura provides an AI-powered receptionist platform for medical practices. As part of this service, participating healthcare practices may send SMS messages to their patients for the following purposes:
- Appointment reminders and confirmations — Notifications about upcoming appointments with options to confirm, reschedule, or cancel.
- Post-visit follow-up instructions — Care instructions and check-ins after office visits or procedures.
- Prescription refill notifications — Alerts when prescriptions are due for refill.
- Lab result availability — Notifications that lab results are ready for review.
- Wellness check-in reminders — Periodic health and wellness follow-ups.
All messages are sent by or on behalf of the patient's healthcare provider through the DeepCura platform. Messages are only sent to patients who have an existing relationship with the medical practice and who have provided consent as described below.
2. Message Frequency & Rates
Message frequency varies depending on your healthcare provider's communication preferences and your appointment schedule. You may receive multiple messages per week during active care periods, or fewer messages during routine care.
Message and data rates may apply. Check with your mobile carrier for details about your messaging plan. DeepCura and your healthcare provider are not responsible for any charges from your carrier.
3. How Patients Provide Consent
Patients opt in to receive SMS messages through their healthcare provider in the following ways:
3.1 Written Consent at the Practice
During new patient registration or at an existing office visit, patients complete a Communication Preferences form that includes the following disclosure:
“By providing your mobile phone number and signing this form, you consent to receive automated text messages from [Practice Name] via DeepCura, including appointment reminders, follow-up instructions, prescription refill notifications, and wellness check-ins. Message frequency varies. Msg & data rates may apply. Reply STOP to opt out at any time. Reply HELP for help. See deepcura.com/resources/sms-consent for full terms.”
The signed consent form is retained by the healthcare practice as part of the patient's records.
3.2 Verbal Consent During Phone Calls
When patients call or are called by the practice's AI receptionist, they are read the following disclosure before opting in:
“We can send you text message updates about your appointments and care from [Practice Name]. Message and data rates may apply. You can reply STOP at any time to opt out. Would you like to receive text updates?”
Verbal consent is recorded and logged in the DeepCura system with a timestamp and the patient's phone number. The call recording serves as the consent record.
3.3 Keyword Opt-In via Text Message
Patients can text START, YES, or SUBSCRIBE to their practice's dedicated phone number to opt in to receiving messages. Upon texting a keyword, the patient receives the following confirmation:
“DeepCura: You are now opted in to receive healthcare messages from your medical practice, including appointment reminders, follow-ups, and prescription notifications. Msg frequency varies. Msg & data rates may apply. Reply HELP for help. Reply STOP to opt out.”
4. Consent Is Not a Condition of Service
Consent to receive SMS messages is not required as a condition of purchasing any goods or services, nor is it required to receive medical care from your healthcare provider. Patients who decline SMS consent will still receive care and may be contacted through other methods such as phone calls or email.
5. How to Opt Out
You can opt out of receiving SMS messages at any time by replying with any of the following keywords:
- STOP
- STOPALL
- UNSUBSCRIBE
- CANCEL
- END
- QUIT
After opting out, you will receive a final confirmation message:
“You have successfully been unsubscribed. You will not receive any more messages from this number. Reply START to resubscribe.”
You will not receive any further messages unless you re-opt in by texting START to the practice's number. You may also contact your healthcare provider directly to request removal from SMS communications.
6. How to Get Help
For assistance with SMS messages, reply HELP or INFO to any message. You will receive:
“Reply STOP to unsubscribe. Msg & Data Rates May Apply.”
You can also contact DeepCura directly at contact@deepcura.com or your healthcare provider's office for questions about the messages you receive.
7. Supported Carriers
Messages are supported on all major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and most regional carriers. Carrier delivery is not guaranteed. Messages may be delayed or undelivered due to carrier restrictions or network issues.
8. Privacy & Data Protection
Your phone number and consent records are stored securely in compliance with HIPAA and applicable privacy regulations. We do not sell, rent, or share your phone number or personal information with third parties for marketing purposes.
